Terms Of Use
This Terms of Use Agreement (“Agreement”) sets forth the standards of use of the excellprint-promotions.com online ordering process. By using the excellprint-promotions.com website, you (also sometimes referred to as the “Customer”) agree to these terms and conditions. If you do not agree with this Agreement, you should immediately cease all usage of this website. excellprint-promotions.com (also sometimes referred to as “We”) reserves the right, at any time, to modify the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted on this website. Your continued use of the website after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications.
Change Orders
Any jobs that have been approved or “sent to press” cannot be altered or changed due to the automated process that results from the “send to press” action. If a request is made for a job change before the digital proof is approved, including, but not limited to, turn around time, quantity, shipping method, etc, a change order fee of $15.00 will be deducted from the refund.
Turn Around/Production Times
All turn around times are based on business days Monday through Friday business hours 8:00am-5:00pm est. and exclude all national and federal holidays. Printing turnaround time starts when your order is submitted and approved. Please note that if your artwork or design files fail to meet our file requirements, your job status will be changed to "Need Artwork" and your printing turn around time will be reset. All jobs submitted into production before midnight will begin production the following business day. As an example, if a 3 day turn around for a job is submitted, approved, and sent to press on a Monday before Midnight, Day 1 of turn around time is Tuesday and the job would be shipped on Thursday, Day 3 of turn around time.
Refund Policy
All sales Are Final. No refund will be issued after the job is “sent to press”. A service fee of $15 will be charged for any canceled orders once the artwork has been uploaded to the site. Customer must notify excellprint-promotions.com within 1 business day of order acceptance to report any defects discovered in the ordered product. 100% of the product must be returned to excellprint-promotions.com within 5 days from the day the job was delivered. In the event the claim is approved by excellprint-promotions.com, a reprint at no cost will be shipped to the Customer via the original paid shipping method.
Marketing Promotions and Discount Codes
Please note that all prices and specifications are subject to change without notice. Check excellprint-promotions.com website for an updated online advertised price. Qualifying purchases should be placed online along with the applicable code and must be paid in full before the promotion expiration. Offers are not valid for previous purchases. Non-shipping related promotions apply to printing charge only; custom quotes, mailing postage, shipping charges and sales tax, etc. is excluded from offer discounts. Shipping promotion is limited to packages shipped within the Continental U.S.
Shipping
Each excellprint-promotions.com job ships via UPS. Once a package has shipped, excellprint-promotions.com will not be responsible for late or damaged packages. Delivery dates are not guaranteed; unforeseen delays may result in additional transit time. No refund of shipping charges will be made on any job once it has shipped.
Transfer of Title
Customer agrees that the shipping terms for all printed products are FOB shipping point and ownership transfers to the Customer upon shipment. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. For any Product that is to be provided to the Customer in an electronic format, the Customer agrees that delivery of such Product shall be deemed to have occurred either (a) at the time we transmit the Product via email or other electronic communication addressed to the Customer, or (b) at the time we transmit a notification to the customer that the Product is available for downloading from the website.
Disclaimer of Warranties
THE EXCELLPRINT-PROMOTIONS.COM WEBSITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EXCELLPRINT-PROMOTIONS.COM MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE USE OR THE RESULTS OF THIS WEBSITE IN TERMS OF ITS CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. EXCELLPRINT-PROMOTIONS.COM WILL HAVE NO LIABILITY FOR ANY INTERRUPTIONS IN THE USE OF THIS WEBSITE. Indemnification
Customer agrees to indemnify and hold excellprint-promotions.com, its affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of Customer’s use of the website, the violation of this Agreement, or infringement by Customer, or other user of the website using Customer’s computer, of any intellectual property or any other right of any person or entity.
Modifications and Interruption to Service
excellprint-promotions.com reserves the right to modify or discontinue the website with or without notice to the Customer. excellprint-promotions.com will not be liable to Customer or any third party should excellprint-promotions.com exercise its right to modify or discontinue the website. Customer acknowledges and accepts that excellprint-promotions.com does not guarantee continuous, uninterrupted or secure access to our website, as operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.
Production Outsourcing
Excell Print & Promotions Inc. reserves the right to assign portions or entire jobs to outside vendors if it determines in its sole discretion.
Design/Artwork Promotion
Excell Print & Promotions Inc. reserves the right to promote artwork designed by our staff and/or materials produced through our website.
Third-Party Sites
This website may include links to other sites on the Internet that are owned and operated by online merchants and other third parties. You acknowledge that we are not responsible for the availability of, or the content located on or through, any third-party site. You should contact the site administrator or webmaster for those third-party sites if you have any concerns regarding such links or the content located on such sites. Your use of those third-party sites is subject to the terms of use and privacy policies of each site, and we are not responsible therefor. We encourage all Members to review said privacy policies of third-parties’ sites.
Compliance with Laws
Customer assumes all knowledge of applicable law and is responsible for compliance with any such laws. Customer may not use the Service in any way that violates applicable state, federal, or international laws, regulations or other government requirements. Customer further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law or regulation.
